Curbing CBP Authority to Impose Tariffs on Container Residues

Yesterday, the Senate passed HR 644, Customs Reauthorization, by a vote of 78-20.   The bill was amended to include HR 1269, which contains an IME-backed provision that precludes Customs and Border Protection from imposing registration and tariff requirements on residues of U.S. goods with no commercial value being brought back to the United States in IITs (Instruments of International Trade) such as tank cars, cargo tanks, portable tanks, and the like.  The “residue” provision was sponsored by Sens. Dan Coats (R-IN) and Heidi Heitkamp (D-ND).
