Hazardous Materials Safety Permit (HMSP) Rider Included in the FY 2015

A policy rider has been included in the FY 2015 Cromnibus. It ensures that FMCSA can no longer sit back and not allow due process remedies for HMSP holders who find themselves automatically disqualified under the program because, on the arbitrary date that their permit expires, these holders find themselves below a performance threshold that even the agency recognizes is not crash-causal.
This is a huge victory for IME, and we would like to be among the first to thank Rep. Charlie Dent (R-PA) for his dogged determination include this provision, and to Senator Roy Blunt (R-MO) who championed it in the Senate. The Cromnibus, HR 83, is named for the “continuing resolution” section that funds DHS at FY 2014 levels until FEB 27 to give the incoming 114th Congress an opportunity to address President Obama’s unilateral immigration reform policy, and the “omnibus” sections that fund that rest of the federal government. The Cromnibus is expected to be enacted. All policy riders, including the HMSP provision, will expire 30 SEPT 2015. IME will continue to work for a permanent resolution to the HMSP automatic disqualification issue.
