Legislation to Clarify EPA's General Duty Clause Reintroduced in Congress with Industry Support

Representatives Pompeo, Matheson, Long and Latta introduced H.R. 888, the General Duty Clarification Act, with support from 25 industry associations including IME. This legislation requires the Environmental Protection Agency (EPA) to institute a rulemaking to define obligations of chemical facility under the General Duty Clause of the Clean Air Act, and to ensure proper future application of the clause based on congressional intent. Furthermore, it would avoid the creation of duplicative efforts or conflicts with other agencies, including the Department of Homeland Security, which would undermine the overall effort to enhance security and safety. A similar bill was introduced by Rep. Pompeo in the 112th Congress.
