IME and DEP Agree to Stay in Legal Proceedings

Today, the Pennsylvania Commonwealth Court granted a joint request by the Institute of Makers of Explosives (IME), the Pennsylvania Coal Association (PCA), their co-petitioners, and the Pennsylvania Department of Environmental Protection (DEP) to stay their legal proceedings while the parties try to reach a settlement. Over the next couple weeks the parties will attempt to charter an Alternatives Committee (AC) in hopes of satisfying industry’s concerns with DEP’s new regulations. The details of the AC are yet to be decided, but IME will seek delay of the implementation deadlines for security plan perimeters while the AC works. The petitioners retain the ability to continue the legal proceedings if their concerns are not satisfied.
