MSHA Increases Civil Penalties


On February 7, 2008, MSHA published a Final Rule on Criteria and Procedures for Proposed Assessment of Civil Penalties increasing certain maximum penalties.  73 Fed. Reg. 7206.  In the Final Rule, MSHA increased three maximum civil penalties under the Federal Mine Safety and Health Act of 1977:  the maximum civil penalty increases from $60,000 to $70,000; the maximum daily penalty increases from $6,500 to $7,500; and the maximum smoking penalty increases from $275 to $375.
