IME Issues Guidance to Recipients of PHMSA “Show Cause” Letters Dated 8/14/09
In the last two weeks, bulk explosives users and grantees of the Pipeline and Hazardous Materials Administration’s (PHMSA) Special Permits numbers 8554, 10751, 11579, and 12677 received letters dated August 14, 2009. The letters informed the grantees of many new conditions PHMSA is considering adding to the SPs and gives them 30 days to respond and “show cause” why the any of the new conditions should not be implemented. The letter leaves open the possibility of PHMSA adding even more new conditions.
The letter has come about because PHMSA is under pressure to restrict or even revoke the SPs from other government entities that are not as familiar with the safety and importance of bulk explosives transportation .
The IME has drafted guidance for grantees to respond to the show cause letters. Grantees are encouraged to use this guidance in formulating their own response to PHMSA.
