Chemical Facility Anti-Terrorism (CFATS)
August 26, 2010 - For SCC awareness, today the Department of Homeland Security (DHS) issued Chemical Facility Anti-Terrorism Standards (CFATS) Administrative Orders to 21 chemical facilities for failure to submit a Site Security Plan (SSP). An Administrative Order does NOT impose a penalty or fine, but directs the facility to take specific action to comply with CFATS – in this case, to complete the SSP within 10 days of receipt.
Administrative Orders are the first step toward enforcement under CFATS. All 21 sites were notified of their SSP submission requirements in 2009 or early 2010, and had 120 days to complete the document. All were also issued warning letters as an additional reminder. The facilities may either comply with the Administrative Order by completing the SSP, or it may contest the Order via the Adjudications Process under CFATS. If the facility does neither, the Department of Homeland Security may later issue an Order Assessing Civil Penalty.
This is the 2nd set of Administrative Orders issued under CFATS. As you are aware, in June 2010, DHS issued 18 Administrative Orders to chemical facilities for failure to submit a SSP. All of those 18 facilities have now submitted SSPs, and those SSPs are in DHS review.
